Kim Zolciak-Biermann and estranged husband Kroy Biermann faced legal drama — and possible foreclosure — ahead of their 2023 split.
Us Weekly confirmed in February 2023 that the Real Housewives of Atlanta alum and her then-spouse’s Georgia mansion was in foreclosure, after Zolciak-Biermann denied in November 2022 that she was having legal trouble.
Zolciak-Biermann and Biermann, who tied the knot in November 2011, purchased the estate — located in Manor Golf & Country Club in Georgia — in 2012 for $880,000.
While Brock & Scott, PLLC announced in February 2023 that the estranged couple’s house was no longer going to auction, their marriage seemingly took a hit amid all the drama. News broke in May 2023 that the Don’t Be Tardy alum filed for divorce from Biermann after quietly separating one month prior.

Kim and Kroy Squash Financial Woes Rumors
“OK you guys, my house had not sold for $257,000,” Zolciak-Biermann explained via a November 2022 Instagram Story. “If you guys think I would let my home that we’ve put millions and millions of dollars into go for $257,000, you’re an idiot, OK? For real.”
In Foreclosure — Part 1
Us confirmed in February 2023 that the pair’s Georgia mansion was in foreclosure and set to be auctioned off the following month. The auction was planned to take place on the steps of the Fulton County courthouse, according to court documents.
“The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed,” the filing read. “The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney’s fees.”
Trust Bank began the foreclosure process in August 2022, according to the docs. The legal proceedings started after Zolciak-Biermann and Biermann defaulted on their mortgage.
Kroy Gets to Cleaning the Property
Days later, the Housewife shared a video of the retired football player cleaning the mansion. “Get yourself a man that does it all, folks, OK? Mhm … yes sir,” she said in the February 2023 clip, as Biermann vacuumed in a pair of black boxer briefs.
Kim Gives a Lavish House Tour
The KAB Cosmetics cofounder continued to keep up appearances in February 2023 when she posted a tour of the family’s lavish home via social media. “OK you guys, this is definitely one of my favorite rooms, called the Hollywood Room. That chandelier, even though it doesn’t look like it, I think it’s 8 feet wide by 7 feet tall,” she revealed in an Instagram Story video. “Whatever, my kids love it.”
Earlier that day, Zolciak-Biermann showed off the house’s newly redone pool for her followers
Daughters’ Denial
The TV personality’s two daughters, Brielle and Ariana, shut down the foreclosure speculation during a February 2023 interview with TMZ. Brielle claimed that the news surrounding their family was a big “misunderstanding” that led to a “crazy” foreclosure story making headlines.
“Don’t believe everything you hear,” Ariana told the outlet. “Everything is still there. We all live there.”
Pressing Pause on the Auction
The law office of Brock & Scott, PLLC announced on February 22, 2023, that the forthcoming sale of the estate would no longer take place. Details about the reason behind the auction cancellation were not given.

More Legal Issues Come to Light
The estranged duo reportedly owe the IRS $1.1 million in unpaid taxes, interest and penalties, according to court documents obtained by TMZ in May 2023. The back taxes are from 2013, 2017 and 2018, per the filing, which also states that Zolciak-Biermann and Biermann owe the state of Georgia $15,000 for 2018 unpaid taxes.
Kroy Files for Divorce Again
Following a brief reconciliation, Biermann filed for divorce in August 2023 for a second time. He requested full legal and physical custody of their four minor children, as well as alimony and child support. Biermann asked for exclusive use of their Atlanta-area home and requested Zolciak-Biermann stay out of the house, which was not granted.
Kroy Pleads With Kim to List Their Georgia Mansion
Biermann filed court documents in August 2023 in an effort to get his and Zolciak-Biermann’s home up for sale ASAP. “He is asking that the court order the house to be placed on the market, and hopefully sold immediately,” Biermann’s lawyer, Marlys A. Bergstrom, said in a statement to Us at the time. “If the court orders it then the court can enforce the order. It is taking control out of the hands of the parties. And this is exactly what needs to be done at this point.”
The following month, Biermann claimed that Zolciak-Biermann was dragging her heels on selling the house to remain in the mansion longer. The estate, however, was due to be foreclosed on in November 2023.
“[Zolciak-Biermann] has stated that she prefers to file for bankruptcy; a move that will ensure that the parties and their children will remain under the same roof for a significant period of time,” he alleged in a September 2023 filing. “Without the receipt of equity from the sale of the marital residence, the parties cannot afford to move out of the residence and into new residences.”
Kim and Kroy Finally Put Georgia Estate on the Market
Us confirmed in October 2023 that the estranged spouses officially listed their Georgia residence for $6 million ahead of foreclosure. According to Zillow, the seven-bedroom, 11-bathroom property was initially listed at $3.2 million in early October. However, on October 16, the price was upped to $6 million.
That same month, the estranged couple filed a restraining order against foreclosure. They argued that the foreclosure would have a negative impact on their family. Truist Bank, however, asked a judge that their request be “denied” after the pair failed to make their August 2023 probationary payment on the estate.
New Year, Same Problem
Us confirmed in January 2024 that Truist Bank filed a new set of documents, claiming that the lender has a “right” to foreclose on the Zolciak-Biermann and Biermann’s home after it failed to sell over the past three months.
The filing stated that Zolciak-Biermann and her estranged spouse “defaulted on their mortgage,” so the bank “intends to exercise its rights” and foreclose on the home if their debt isn’t paid.
Truist Bank Is Getting Restless
Truist Bank submitted more documents to the court in April 2024 that gave Biermann and his estranged wife until May 3, 2024, to return to court and sort out what they owe the lender.
The docs were filed on April 23, according to People and state that the bank could start the foreclosure process once again, even though the house is for sale. If Truist Bank does begin the foreclosure, the family wouldn’t have to immediately vacate the property, per the filing, but it would force them to start repaying their debt.
