TEEN Mom Jenelle Evans has her hands tied regarding kicking her estranged husband, David Eason, off the couple’s boat, which he’s been living on since their separation earlier this year.
The U.S. Sun can exclusively reveal that Jenelle, 32, “can’t evict” David, 35, due to legalities in their divorce case and will have to let things “play out” in court first.
Following the couple’s court date on Thursday, April 25, pertaining to a second case about the protective order Jenelle requested against David, a source close to the pair revealed some intel on their living situation.
The U.S. Sun previously reported that the former MTV star had been living on their boat since February due to a stay-away order against him for Jenelle’s oldest son, Jace, 14, who accused David of allegedly assaulting him.
In pursuit of the exes’ split, David extended his stay on their boat at a North Carolina marina, and, according to the source, Jenelle legally can’t make him leave.
“It gets a little bit more complicated when there’s a divorce action that’s been filed,” the insider revealed about the messiness of the situation.

“So, everything that happened with the boat and any other personal belongings acquired during their marriage will have to be disposed of with the court’s permission.”
The source continued, “At this time, there’s not really any legal avenue for Jenelle to evict David off the boat, even though it’s a separate property. She’s going to let the court case play out before taking any sort of steps like that.”
‘IT’S MY SANCTUARY’
In Jenelle’s protective order filing, the ex-TV personality alleged that David hadn’t relinquished the keys to the vessel despite her repeated requests for them.
In April photos exclusively obtained by The U.S. Sun, David was captured walking around the docks with an electric toothbrush after washing up in the marina’s restroom.
Around the same time, David gushed on TikTok over his love for the boat and how much he enjoyed living on it.
“This is my home; it’s my house where I live. It’s my sanctuary,” the former reality star said. “I don’t even bring people back here.”

For now, it appears David won’t be pressed to jump ship as more important matters need to be resolved first in his and Jenelle’s divorce.
The U.S. Sun reported on Wednesday that the court in Jenelle and David’s divorce battle made the custody over their 7-year-old daughter, Ensley, the main priority.
The same insider revealed that that should be handled soon, as Jenelle is vying for full custody of Ensley, their only child.
“In North Carolina, whenever someone is served with a civil case, we have 30 days to respond. I believe those 30 days just about ran [out]. So the time to answer or respond has expired,” the insider explained.

Jenelle got pregnant in April 2016 and announced she suffered a miscarriage, then she became pregnant again with her and David’s daughter, Ensley, a few months later.
The pair got engaged in February 2017 and tied the knot that September.
A year after saying “I do,” Jenelle called 911 and accused David of assaulting her outside their home. She would later call the incident “a drunk and dramatic misunderstanding” and said she was “fine.”
In around May 2019, David shot and killed their French bulldog puppy named Nugget. Weeks after the incident, CPS took custody of all of the children, including their daughter, Ensley, Jenelle’s son, Kaiser, and David’s daughter, Maryssa.
When her children were returned to her, Jenelle fled to Tennessee with Kaiser and Ensley and filed an order of protection against David in October. She ultimately dropped the case and went back to him.
In the following years, the couple sparked split rumors as the pair would often unfollow each other on social media and update their Facebook relationship statuses.
As The U.S. Sun exclusively reported, on February 23, 2024, Jenelle filed for separation from David. She stated that she filed the documents with “the intent that the separation be permanent” and claimed that Eason had “exhibited concerning and at times disturbing behavior towards [her]” throughout their marriage.
“The courts will then start putting her on the calendar, and so typically, one of the first things that they’ll do, and based on what she has filed, is she will work to set up temporary child custody. So that’ll probably be the first step.”
While the source confirmed that Jenelle hasn’t filed anything additional in her and David’s divorce case, aside from the domestic violence restraining order, a second source claimed that Jenelle is confident the court will be on her side.
The insider, who is close to Jenelle, revealed she has “something major on David that she is keeping super close to her chest. This is a smoking gun, and she plans to use it during her divorce from him.”
FAMILY DIVIDED
David is also facing a third case regarding his felony charges for the alleged incident with Jace, which supposedly happened in September.
While David must keep his distance from Jace per the stay-away order, Jenelle recently allowed him back home following an attempted break-in.
Jenelle’s manager claimed to The U.S. Sun that authorities approved that David could briefly move back in to “protect the family.”
In addition to Ensley and Jace – whom Jenelle shares with her ex, Andrew Lewis – the ex-TV star is a mom to a 9-year-old son, Kaiser, with her ex-husband, Nathan Griffith.
Jenelle’s attorney recently told The U.S. Sun that David hasn’t attempted to contact Ensley since their separation.
The U.S. Sun reached out to David’s rep for comment but has not heard back.
